Terms of Use — RestoManager
Effective date: October 10, 2026
These terms have two parts:
- Part A applies to businesses that subscribe to RestoManager;
- Part B applies to everyone who uses the app, including employees.
The RestoManager Privacy Policy is part of these terms.
Part A — Customer Terms of Service
A1. The parties
This contract is between Labontech inc., a company based in Lac-Beauport, Quebec ("Labontech"), and the business that creates a RestoManager account (the "customer").
The person accepting these terms confirms they have authority to bind the customer. The customer accepts these terms in any of these ways:
- by ticking the acceptance box;
- by signing an order form;
- by using the service.
A2. The service
RestoManager is a team management platform for restaurants. It includes, among other things:
- scheduling and availability;
- time clock and timesheets;
- messaging and tasks;
- employee onboarding;
- artificial intelligence features (draft schedules, tasks created from messages, document reading).
The features available depend on the plan chosen and may change. We will not remove an essential feature from your plan during a subscription term without at least 30 days' notice.
A3. Artificial intelligence and compliance
RestoManager proposes draft schedules, suggestions and alerts generated in part by artificial intelligence. These outputs are aids. The customer must review them before publishing or relying on them.
The customer remains solely responsible for its decisions as an employer and for complying with the laws that apply to it, including:
- Québec's Act respecting labour standards and other labour standards laws;
- occupational health and safety laws;
- collective agreements;
- tax and payroll laws.
RestoManager does not provide legal, tax or accounting advice.
A4. Accounts and users
The customer appoints its account administrators and invites its managers and employees. The customer is responsible for:
- the accuracy of the information it enters;
- the access it grants;
- promptly removing access for people who no longer work for it.
The customer keeps its credentials secure and notifies us without delay of any unauthorized access.
A5. Pricing, billing and taxes
Prices are those of the chosen plan, in Canadian dollars, plus applicable taxes (GST, QST or HST). Payment is processed by a secure payment provider.
- Subscriptions renew automatically for the same term unless cancelled before the renewal date.
- We may change our prices with at least 30 days' notice. The new price applies at the next renewal.
- If a payment is more than 15 days late after a notice, we may suspend access until it is paid.
- Amounts paid are non-refundable, except where the law requires it or we agree in writing.
Specific agreements, such as the founding partner program, prevail over this section if they conflict.
A6. Customer data and personal information
Ownership. Data that the customer and its users enter in RestoManager belongs to the customer ("customer data").
Our role. For the personal information of the customer's employees, Labontech acts as a service provider. We:
- process it only to provide the service, on the customer's instructions;
- protect it with reasonable security measures;
- do not use it for any other purpose;
- do not sell it.
The Personal Information Processing Agreement attached as a schedule sets out these commitments, as section 18.3 of the Act respecting the protection of personal information in the private sector requires. It is attached to the order form and provided on request.
Customer obligations. As the employer, the customer:
- informs its employees that it uses RestoManager and about the privacy policy;
- collects only the information it needs;
- obtains the required consents;
- informs its employees about performance tracking and gives them access to their statistics when they ask;
- enters information about a worker under 14 only if it may legally employ them, and after obtaining written consent from their parent or guardian;
- answers its employees' requests about their employment record, with our help when needed.
Location-based presence check remains each employee's choice. The customer does not require it and accepts punches marked "presence not checked", which it reviews.
Aggregated data. We may use anonymized, aggregated data that cannot identify the customer or any person to improve the service and produce statistics.
Hosting. Customer data is hosted in Canada. The subprocessors we use and where they process data are described in the privacy policy.
A7. Acceptable use
The customer and its users must not:
- use RestoManager for unlawful purposes or to monitor people beyond what the law allows;
- upload content that is unlawful, hateful, harassing or infringes others' rights;
- try to access another customer's data, bypass security or disrupt the service;
- copy, resell or reverse-engineer the software, or use it to build a competing product.
A8. Availability and support
We use reasonable efforts to keep RestoManager available at all times, except during planned maintenance, announced in advance when possible.
Support is available in French and English at support@restomanager.ca.
A9. Intellectual property
Labontech keeps all rights in RestoManager, its software, brand and documentation. For the duration of its subscription, the customer receives a non-exclusive, non-transferable right to use the service for its business.
Labontech may freely use suggestions or feedback the customer sends, with no obligation to the customer.
A10. Confidentiality
Each party keeps the other's non-public information confidential and uses it only to perform this contract. This obligation continues after the contract ends.
A11. Warranties
We provide the service competently and in a workmanlike manner. Except as these terms state, the service is provided "as is". We do not guarantee that it will be error-free or uninterrupted, or that it will suit a particular purpose.
A12. Limitation of liability
To the extent the law allows:
- neither party is liable for indirect damages, including lost profits, revenue or data;
- Labontech's total liability to the customer is limited to the amounts the customer paid for the service in the 12 months before the event giving rise to the claim.
These limits do not apply:
- to intentional or gross fault;
- to bodily or moral injury;
- to other cases where the law does not allow liability to be limited.
A13. Term and termination
This contract runs as long as the customer has an active subscription.
- By the customer: it may cancel at any time from its account. Cancellation takes effect at the end of the period already paid.
- For breach: either party may terminate if the other commits a material breach and does not fix it within 30 days of written notice.
After termination, the customer has 90 days to export its data. We then delete customer data, except what the law requires us to keep.
A14. Changes to these terms
We may change these terms. We notify the customer by email or in the app at least 30 days before a significant change takes effect. If the customer does not accept the change, it may cancel without charge before it takes effect.
A15. Governing law
This contract is governed by the laws of Québec and the federal laws of Canada that apply there. The courts of the judicial district of Québec have exclusive jurisdiction, unless the law provides otherwise.
A16. Language
This contract was first presented in French. This English version is provided as a courtesy. At the customer's express request, it may be bound by the English version.
A17. General
- Entire agreement: this contract, with its schedules and the order form, is the entire agreement between the parties.
- Severability: if a clause is held invalid, the others remain in force.
- Assignment: the customer may not assign this contract without our consent. We may assign it as part of a sale or reorganization of our business.
- Force majeure: neither party is liable for a delay caused by force majeure (superior force).
Part B — App Terms of Use
B1. Accepting these terms
By creating an account or using the RestoManager app, you accept Part B and the privacy policy. You must be 14 or older.
B2. Your employer and us
Your restaurant (your employer) gives you access to RestoManager. Labontech is not your employer. Your employer decides:
- your schedule;
- the approval of your hours;
- your pay;
- your leave.
For questions on these topics, contact your employer.
B3. Your account
- Give accurate information and keep it up to date.
- Keep your password and your phone secure. Do not share your account.
- You can delete your account at any time (section 13 of the privacy policy).
B4. Honest use
You agree to:
- punch only for yourself, when you actually start and finish work;
- not fake your location or Wi-Fi network, or get around presence checks;
- respect your coworkers in messaging: no harassment, hate speech, threats, sexual or unlawful content;
- not try to access other people's information or interfere with the app.
B5. Content you post and moderation
Your messages, photos and files remain yours. You give us the right to host them and show them to the people concerned so the service can work.
Prohibited content and moderation. You may not post harassment, hate speech, threats, sexual content, another person's personal information without their consent, or any unlawful content. Message text is filtered automatically before it is saved, and a clearly unacceptable message is refused. Your employer and Labontech can remove a message and suspend its author's access.
You can report a message or a task created by AI with the Report feature or by writing to support@restomanager.ca, and block a user to stop seeing their messages. Your employer handles reports; our team follows up within one business day.
B6. Artificial intelligence
AI suggestions and AI-created tasks are generated automatically and may contain errors. Check any important information, such as your hours or your schedule, with your employer.
B7. Device permissions
When needed, the app asks for access to:
- location (presence check when you punch);
- camera and photos (profile photo, attachments);
- notifications.
At the restaurant's kiosk, the tablet uses NFC to read your badge, if your employer provides one.
Each permission is optional. If you refuse one, only the related feature is limited.
B8. Availability
We do our best to keep the app working at all times but cannot guarantee it. During an outage, use the punch method your employer provides, such as the kiosk or a manual entry.
B9. Ending access
By your employer: they can remove your access to their restaurant.
By Labontech: we may suspend an account that breaks these terms. We let you know, unless doing so would compromise an investigation or security.
B10. Liability
The app is free for employees. To the extent the law allows, Labontech is not liable for indirect losses arising from its use.
Nothing in these terms limits rights the law gives you that cannot be waived.
B11. Apple and Google
These terms are between you and Labontech, not Apple or Google. Apple and Google are not responsible for the app or its support.
If you downloaded the app from the App Store, Apple's Standard Licensed Application End User License Agreement also applies. If they conflict, these terms prevail to the extent Apple allows.
B12. Changes, governing law and language
Changes: we notify you in the app of any significant change to Part B.
Governing law: the laws of Québec apply.
Language: these terms were first presented to you in French. You may expressly choose to be bound by the English version.
